Constitutional Law, the Global South and Covid-19: Comparing Colombia, South Africa and India

The response of constitutional democracies in the Global South - such as Columbia, South Africa and India - to the COVID-19 pandemic raises a range of interesting questions flowing from the specific circumstances of these societies. These include high levels of absolute poverty, socio-economic inequality and limited capacity within the state and continuing efforts to entrench a democratic culture.

The panel will focus on the following issues:

-Under which constitutional structures have lockdowns been declared?

-Did governments adopt the least restrictive measures on fundamental rights when imposing social distancing requirements?

-Have there been constitutional challenges to these measures?Were the successful?

-Did socio-economic rights assist in the time of lockdown?

-Global democracies remain fragile, did authoritarian tendencies display themselves or was there an entrechment of a culture of

constitutionalism?
