Just Enough – The EU Proposal for a Carbon Border Adjustment Mechanism

The Commission's draft is only useful as a diplomatic lever. A Carbon Border Adjustment Mechanism (CBAM) must be comprehensive and integrated into the global trading system.

Compared to a global solution or a climate club, a carbon border adjustment (CBAM) is the worst option. However, if the EU does not want to be dependent on the goodwill of other states, it should design a comprehensive border adjustment that is as open as possible for third countries. The leaked draft of the EU Commission on the CBAM is very limited and can thus only have an impact as a threat or as a first step.

Nature – a Legal Subject: Could the Colombian model work for Germany?

In sensational rulings, Colombia's High Courts have granted natural features such as the Atrato River and the Colombian Amazon legal personality.

In view of growing climate litigation in Germany, Colombia's jurisprudence, which grants rights to rivers, forests and animals, is getting increasing attention in this country. The German legal tradition is no stranger to recognizing rights in favor of entities that are not natural persons, for example legal persons. However, granting subjective rights in favor of the environment might shift the sovereignty to interpret such rights from the legislature to the courts.

Germany and India in the Indo-Pacific: United or Untied?

Given the high degree on convergence between India and Germany in the Indo-Pacific, how can both actors strengthen their cooperation in the region?

Policymakers and scholars have paid much attention in recent years to the emergence of the term ‘Indo-Pacific’ to describe the changing regional security system in Asia. The concept has not only become popular in Asia but also in America and Europe. This paper highlights the Indian approach to the Indo-Pacific and the responses to the German Indo-Pacific guidelines. It also offers some recommendations to forge a stronger link between Indian and German approaches in the Indo-Pacific.
