Sustainable Extractive Industries: The Role of Local Content provisions

Policy brief

Enhancing local content in mineral supply chains holds the potential to contribute to employment and socio-economic development in mining jurisdictions, as well as improve mining companies’ social license to operate. Yet poorly framed and implemented local content frameworks can have a number of negative impacts, including undermining the competitiveness and even viability of certain operations. Almost all countries with significant extractive industries (mining as well as oil and gas) have some form of regulatory framework seeking to support greater local engagement in extractive value chains, but these policies have a mixed record of success and there is a great diversity in how these frameworks have been designed. This policy brief outlines key recommendations emerging from a workshop convened by the Konrad-Adenauer-Stiftung’s (KAS) Regional Programme for Energy Security and Climate Change in Sub-Saharan Africa and the South African Institute of International Affairs, which was hosted on 18 July 2019 in Gaborone, Botswana. Recommendations centre on the question of how ‘local’ is defined in the context of local content provisions, considerations related to industry competitiveness, the issue of reporting and transparency, and the relationship between corporate social responsibility and local content provisions. The key conclusion is that, while implementation challenges and potential impacts on competitiveness related to local content requirements must be acknowledged, this should not justify inaction; there is a need for a systematic, incremental and transparent process to enhance local content in mineral supply chains.

Arbitration in Myanmar and other ASEAN countries

In Myanmar, not much awareness has been brought to the new Arbitration Law that passed in 2016, yet progress can already be observed as shown by the recent establishment of the Myanmar Arbitration Centre last August. Arbitration has the potential to encourage more foreign direct investment in a country ranked 110 among the 126 countries monitored in the Rule of Law Index by the World Justice Project (WJP). Through our publication “Arbitration in Myanmar and other ASEAN countries”, we seek to get the public more acquainted with this resolution procedure.

Das Europäische Parlament hat in seiner Sitzung am Mittwoch die neue Europäische Kommission von Präsidentin Ursula von der Leyen mit breiter Mehrheit bestätigt. Ab dem 1. Dezember beginnt die Amtszeit, für die sich die neue Kommission ehrgeizige Ziele gesteckt hat. Von der Leyen hat, wie schon Mitte Juli kurz nach ihrer überraschenden Nominierung, einen überzeugenden Auftritt vor dem Europäischen Parlament absolviert und eine klare Vision vorgestellt, in welche Richtung sowie mit welchen Prioritäten sich die Europäische Union in den kommenden Jahren entwickeln soll.

Das kleine Land östlich des Flusses Uruguay galt mit seinen 3,5 Mio. Einwohnern lange als Insel der Stabilität und Sicherheit im politisch stürmischen Wellenmeer Lateinamerikas. Nach 15 Jahren sozialistischer Regierung bröckelt die Farbe des einstigen Wohlstandsdampfers und die Wähler schenkten in den kürzlich stattgefundenen Präsidentschaftswahlen ihr Vertrauen einer neuen Allianz aus bürgerlich-konservativen Parteien. Schafft es Uruguay auf Kurs zu bleiben oder droht auch hier der politische Schiffbruch?

A 30 años de la caída del Muro de Berlín

Con motivo de la serie de eventos de la KAS Chila para el aniversario “A 30 años de la caída del muro de Berlín” y a pesar de la crisis social a la que el país se ve enfrentado actualmente, el Alcalde Hänisch viajó a Chile para dar su charla en Santiago, Valdivia, Puerto Varas y Temuco y para compartir sus experiencias con respecto a las manifestaciones pacíficas en el tiempo de la RDA. Se intercambió con escolares, universitarios, académicos, políticos y feligreses de la iglesia. Más actual no podría haber sido. Algunos oyentes se sorprendieron por la capacidad de respuesta por parte del equipo de la KAS Chile.

Die Stadt Belgrad bildet das Herz Serbien und ist eine der bedeutendsten Städte in Südosteuropa. Als wichtigstes politisches, wirtschaftliches und kulturelles Zentrum Serbiens, gab und gibt es eine Reihe von Möglichkeiten und Herausforderungen, denen sich die Stadt stellen musste und dies anzunehmen gilt. In diesem Zusammenhang hat Belgrad viele kritische Entwicklungen im Stadtbild, der Kultur und Politik durchlebt. Die Stadt Belgrad lebt, pulsiert und verändert sich; sie ist eine Stadt im Wandel, bedacht darauf ihren Platz als europäische Metropole zu behaupten. Dieser Wandel ist jedoch nicht frei von Herausforderungen.

Globaler Rückzug mit Ausnahmen

Die aktuelle mexikanische Außenpolitik zwischen Apathie, Wirtschaft und Ideologie

Seit Beginn der Legislaturperiode im Dezember 2018 fokussiert sich die mexikanische Regierung unter Andrés Manuel López Obrador (AMLO) explizit auf innenpolitische Probleme und Reformen und hat sich stark aus außenpolitischen Initiativen und internationalen Foren zurückgezogen. Leitlinie ist dabei die konstitutionell verankerte Maxime der Nicht-Intervention in die nationalen Angelegenheiten anderer Länder (Estrada-Doktrin). Im Falle von wirtschaftlichen Vorteilen oder ideologischer Nähe ist die Regierung allerdings durchaus zum Eingreifen bereit. Es bleibt abzuwarten, ob sich dies in naher Zukunft wandelt.

Landesweiter Generalstreik in Kolumbien

Der erste Schritt zum Scheitern der Regierung oder Chance für Dialog?

Seit dem 21. November (21N) herrscht in Kolumbien ein landesweiter Generalstreik, der zu Spannungen zwischen den Streikenden und der Regierung geführt hat, jedoch bisher – bis auf einige Auseinandersetzungen mit kleineren gewaltbereiten Gruppen – im Wesentlichen friedlich verlaufen ist. Künstlerische Happenings verwandelten viele Straßen des Landes in ein großes demokratisches Fest. Die Motive, die zu dem Streik geführt haben, sind allseits bekannt: Es sind dieselben Probleme, die vor allem von den ärmeren Bevölkerungsschichten seit vielen Jahren angeprangert werden, bei den jeweiligen Regierungen jedoch bislang auf taube Ohren gestoßen sind. Vor der Unterzeichnung des Friedensabkommens mit der FARC Guerilla im Jahr 2016 argumentierten die Regierenden stets mit der Priorität des bewaffneten Konflikts - jetzt nach dem Friedensabkommen werden die strukturellen Probleme immer sichtbarer und die Bevölkerung duldet keinen weiteren Aufschub mehr.
