Legal Encounter - "The Legal Framework Regulating Governmental-Owned Land"

On January 17th, 2011, judge Dr. Abd Al Qader Jarada held a lecture about the legal framework regulating state-owned property. The lecture took place in the context of the “Legal Encounter” series of lectures, based on a co-operation between the Institute of Law (IoL) of Birzeit University and the Konrad-Adenauer-Foundation (KAS) Ramallah.

Dr. Jarada began his lecture by declaring the historical development of land law, starting from the early Islamic and later Ottoman era, until the British mandate and finally the Palestinian National Authority. He declared that during the time of the Ottoman Empire land was divided into five categories: 1. Privately owned land; 2. Public land; 3. Wasted land; 4. Abandoned land; 5. Endowment land. Dr. Jarada then explained the regulation of land, what kind of legal proceedings apply, and how it is managed. He also stated that 95% of the land in Gaza is in fact owned by the government.

The lecture, which took place in the IoL building in Gaza, was attended by 23 lawyers.
