Reinforcing Judicial and Legal Institutions

Kenyan and Regional Perspectives

The 5th volume of the bi-annual publication "Judiciary Watch Series", which is published in cooperation with the International Commission of Jurists - Kenya Section, deals with common problems of Rule of Law in East Africa. The authors analize the Independence of the Judiciary in Kenya, the Office of the Attorney General in East Africa, Constitution Making and Constitutional Reform in Fledgling Democracies, Human Rights Litigation in East Africa, Application and Compliance with International Human Rights Standards in East Africa, Independent Constitutional Commissions in East Africa and the East African Court of Justice. This against the background of Judiciaries in the region asserting their independence with decisions sometimes against governments, while democracy is threatened by governments which begin to show authoritarian tendencies - especially in Uganda. The publication is made available to important decision makers in the region and aims at contributing to the discussion and solution of problems regarding Rule of Law in East Africa. This complements the activities of the Konrad Adenauer Foundation Rule of Law Program for Sub-Saharan Africa.

Ausgabe November 2006

Die November-Ausgabe der monatlich erscheinenden Zeitschrift "Katiba (Kisuaheli für "Verfassung") News" beschäftigt sich regelmäßig mit für die Verfassungsreform in Kenya wichtigen und strittigen Themen. Der durch das negativ ausgegangene Referendum zur Verfassungsreform im November 2005 zunächst ins Stocken geratene Verfassungsreformprozess ist nun wieder in Gang gekommen. "Katiba News" will hier einen Beitrag zur Lösung strittiger und wichtiger Fragen leisten. Gegenwärtig will in Kenya das eine politische Lager noch vor den Wahlen im Dezember 2007 sog. "Minimum Reforms" durchführen, das andere Lager will dagegen "Comprehensive Reform". Kenyanische Experten untersuchen in dieser Ausgabe "Für" und "Wider" von "Minimum Reforms" und "Comprehensive Reform". Dabei ist Wert darauf gelegt worden, daß die Autoren verschiedenen politischen Lagern zuneigen, so daß sich ein vollständiges Bild der gegenwärtigen Debatte in Kenya ergibt.

Issue October 2006

The October Issue of the monthly newsletter "Katiba (Kisuaheli for "Constitution") News" deals regularly with important and controversial issues of constitutional reform in Kenya. The constitutional reform process had stalled after the negative result of the referendum in November 2005 but has recently been revived. "Katiba News" wants to contribute to finding a solution to important and controversial problems in this process. In this issue kenyan constitutional experts analize strengths and weaknesses of a parliamentarian system as well as the role, responsibility and control of Parliaments and Parliamentarians. It tries to answer the question if a parliamentarian system would be an alternative for Kenya.

Judiciary Watch Report

The African Human Rights System

The 4th volume of the bi-annual publication "Judiciary Watch Report" which is published in co-operation with the International Commission of Jurists - Kenya Section deals with the Human Rights situation in Africa, with special emphasis on the relations between the African Commission on Human and Peoples' Rights and the future African Court on Human and Peoples' Rights which is scheduled to commence its work in 2008. Authors from Kenya, Tanzania and South Africa analize the situation of Human Rights in Africa, the history of the African Human Rights Commission and the African Court on Human Rights as well as strenghts, weaknesses and challenges to these two institutions as far as safeguarding Human Rights in Africa is concerned. The publication is made available to important decision makers in the region and aims at contributing to the discussion and solution of problems regarding Human Rights on the continent. This complements the activities of the Konrad Adenauer Foundation Rule of Law Program for Sub-Sahara Africa.
