What is Just and Equitable Compensation for Land Reform?

SAIFAC and UJ Faculty of Law, in collaboration with the Konrad Adenauer Foundation, will be hosting a day seminar on what constitutes just and equitable compensation in the context of the expropriation of land for purposes of land reform.

Details

The purpose of this seminar was to rethink the way in which compensation for expropriation is approached in South Africa, what the implications of this might be for the state’s land-reform initiatives, and to offer suggestions on how to solve problems experienced thus far, given the key role that land reform is to play in rectifying the injustices that occurred during apartheid.

This seminar explored various issues connected with the compensation requirement and focus on three key topics: who should be compensated for expropriation, who should pay compensation, and the constitutionality of awarding compensation that is below market value when the purpose is land reform.
