Conference "Rule of Law Checklist Montenegro"

At the event "Rule of Law Checklist for Montenegro", first of all one of the authors, Mr. Milorad Markovíc will present the work "Rule of Law Checklist for Montenegro" published in 2020. This analysis deals with the rule of law structures of the EU accession candidate Montenegro. The basis for this study is the "Rule of Law Checklist" of the Venice Commission, which was structured and adapted by Dr. Mahir Muharemovic of the Konrad Adenauer Foundation. The focus of the analysis is to examine the practical implementation of rule of law criteria in Montenegro. After the presentation of the publication, high-ranking Montenegrin legal experts and representatives of the judiciary will discuss challenges to the rule of law in Montenegro in the second part of the event. The current COVID-19 pandemic proofs the need for digitalization in every area of life - including in justice. While first steps are already taken, there are still a lot of obstacles on the way to a digital access for citizens to justice and automation of court hearings. In this context, Estonia with its multiple approaches to build a digital society is considered a pioneer in Europe. What are the opportunities and challenges of the digitalization of justice? „Rights of Religious Minorities in North Macedonia“ - Conference on Student Religious Literacy

The Rule of Law Programme South East Europe has organised together with its partner, Iustinianus Primus Faculty in Skopje, a conference on Student Religious Literacy. The guest speakers were Professors Tanja Karakamischeva-Jovanovska and Alexandar Spasenovski as well as Dr. Jovan Jonovski from behalf of the Evangelic-Protestant Initiative. The main topics that were debated together with the students from the faculty were „International and Domestic Standards Related to the Exercise of the Religious Freedom“, „The Role of the Religious Communities in a Democratic State“ and „Exercising Religious Freedom“. The conference was organised within the project „Rights of Religious Minorities in North Macedonia“ and it is the third meeting of this kind that took place in Skopje during this year.

Conferinţa a reunit experţi internaţionali în domeniul dreptului european care au încercat să clarifice noutăţile aduse de Tratatul de la Lisabona.

Das KAS-Rechtsstaatsprogramm Südosteuropa hat sein Projekt zur Förderung der Rechte von Beschuldigten, Angeklagten und ihrer Verteidigung im Strafverfahren mit einem Seminar zur Rechtslage in Rumänien am 6. März 2008 in Cluj-Napoca (Rumänien) fortgesetzt. Die Leiterin des Rechtsstaatsprogramms Südosteuropa (RSP SOE), Frau Dr. Stefanie Ricarda Roos, hat das Seminar mit einer einleitenden Rede zu den Gründen für die Unterstützung von europaweiten Mindeststandards in Strafverfahren durch das KAS-RSP SOE eröffnet.

Bericht über das Studien- und Dialogprogramm zum Thema "Lustration"

für Experten aus Südosteuropa, 18. - 22. Februar 2008, Berlin

Deutschland und die Länder Südosteuropas haben gemeinsam, dass sie sich nach wie vor mit den Folgen der totalitären bzw. autoritären Herrschaftssysteme des 20. Jahrhunderts konfrontiert sehen. Die postkommunistische/-sozialistische Systemtransformation kann nur gelingen, wenn in diesen Ländern eine Auseinandersetzung mit und Aufarbeitung von Geschichte und Folgen dieser Systeme stattgefunden hat. Ausgehend von dieser Überzeugung hat die KAS vom 18.–22.02.2008 zehn Fachleute aus SOE zu einem Studien- und Dialogprogramm „Lustration“ nach Berlin eingeladen. Näheres hierzu in unserem Bericht.

Nicht immer ist das Verhältnis zwischen gestaltender Politik und der Kontrolle der Verfassungsgerichtsbarkeit völlig spannungsfrei. Am 10. November 2007 diskutierten Rechts- und Politikwissenschaftler, Juristen und Politiker angesichts der Gewaltenteilung die Grenzen der Verfassungsgerichtsbarkeit in Bulgarien. Hauptredner war Prof. Dr. Grimm, Richter i.R. am Bundesverfassungsgericht in Deutschland und Mitglied des Wissenschaftkolleg zu Berlin. Die Eröffnungsrede lieferte Dr. iur. Stefanie Ricarda Roos, Direktorin des Rechtsstaatsprogramm Südosteuropa der Konrad-Adenauer-Stiftung.

Grundsätzliches Ziel des interdisziplinären Forschungsprojektes ist es, die Dynamik und vor allem die Tendenz hinsichtlich der Verschlechterung von Autorität und Social Trust in drei gesellschaftlichen Bereichen, dem Recht, höherer Bildung und Wissenschaft, im Gesamtkontext der Globalisierung zu untersuchen unter besonderer Berücksichtigung (europäischer) post-totalitärer Gesellschaften.
