Rule of Law Handbook for Environmental Law

This publication is part of our Rule of Law Handbooks series, and aims to inform a large audience about the international standards on environmental laws and Myanmar’s application of these. We hope to encourage more public participation on these issues in order for Myanmar’s sustainable development to be envisioned and carried out in an inclusive manner.

Arbitration in Myanmar and other ASEAN countries

In Myanmar, not much awareness has been brought to the new Arbitration Law that passed in 2016, yet progress can already be observed as shown by the recent establishment of the Myanmar Arbitration Centre last August. Arbitration has the potential to encourage more foreign direct investment in a country ranked 110 among the 126 countries monitored in the Rule of Law Index by the World Justice Project (WJP). Through our publication “Arbitration in Myanmar and other ASEAN countries”, we seek to get the public more acquainted with this resolution procedure.

Reforming Myanmar’s 2008 Constitution: a key element to the country’s democratic transition

The landslide victory of the National League of Democracy (NLD) during the 2015 elections against the the Union Solidarity and Development Party (USDP), the military backed-party in Myanmar, was celebrated across the country but also worldwide, as a symbol of democracy triumphing over decades of military rule. However numerous obstacles remain to be faced by the civilian government in its quest for consolidating democracy. One of these obstacles might well be the 2008 Constitution of Myanmar. One may wonder, how is amending Myanmar’s Constitution, key to the democratic reform process of the country?

Myanmar und Bangladesch – ein gestörtes Verhältnis

Am 7. November bestellte das Außenministerium Bangladeschs den Botschafter Myanmars ein, um ihm eine Protestnote zu überreichen. Grund dafür war ein Vorfall, der sich drei Tage vorher an der gemeinsamen Grenze beider Länder ereignete: Myanmars Grenzschutz soll am 4. November das Feuer auf das Territorium Bangladeschs eröffnet und dabei zwei Menschen verletzt haben. Bei den Verletzten handelt es sich nach Presseberichten um einen Bangladeschi und einen Rohingya aus Myanmar, welcher im Flüchtlingslager in Cox’s Bazar lebt. Myanmar stritt diese Vorwürfe ab. Dieser Vorfall ist nicht der erste in der Grenzzone zwischen beiden Ländern. Er steht symptomatisch für ein in nahezu jeder Hinsicht schwer gestörtes Verhältnis zwischen den Nachbarn.

At the start of the Lunar New Year, the Chinese ambassador in Yangon praised Myanmar for having maintained political stability and making progress in the peace process. He said that China had played a constructive role in the process and would remain a presence. The assembled Burmese ministers, regional dignitaries and parliamentarians must have had mixed feelings upon hearing this. For decades, China has been pursuing ambitious goals in Myanmar, not always to the satisfaction of its neighbour. The West’s policy once again risks increasing Myanmar’s dependence on China.
