Remuneration of Court Appointed Experts and Clerks´ Travel Expenses

On the 12 and 13 November 2018, the Rule of Law Program Middle East/North Africa of the Konrad-Adenauer-Stiftung organizes in collaboration with the Lebanese Supreme Judicial Council a workshop on “Remuneration of Court Appointed Experts and Clerks´ Travel Expenses” in Beirut, Lebanon.

Details

The expert knowledge is indispensable for court proceedings. They provide the judge with information about technical, scientific or other matters which are essential for the interpretation of complex facts. In this way, the experts give the judge the necessary expertise and recommendations to be able to reach a verdict.

The Lebanese legal system regulates according to the Legislative Decree No.65/1983 the criteria for the definition and selection of possible experts, but the remuneration of experts is left to the discretion of the judge. There are no clear rules, remuneration schemes or guidelines. This makes it more difficult for the parties, for example, to estimate the costs of litigation. As a result, an unequal, arbitrary and non-transparent compensation system prevails, which affects the credibility of the judicial system.

In a two-day workshop, judges and experts will meet to discuss, on the basis of a study developed by the KAS, the harmonization of the remuneration of court-appointed experts and clerks, with the aim of improving the judicial administration, promoting an independent judiciary by supporting the reform of norms and avoiding unnecessary and disproportionate costs in litigation for parties seeking justice.
