Research on the socio-economic legislation in the West Bank and Gaza

The Institute of Law (IoL) at Birzeit University conducts a research project in partnership with the Konrad-Adenauer-Stiftung

For 2019, IoL recruited a research team to look closer into the socio-economic legislation in Palestine. The studies are related to the right to health, the right to work, and the right to housing of Palestinians in the West Bank and the Gaza Strip. Furthermore, IoL worked on a possible application of the social market economy in Palestine.

In course of the research, a paper entitled “Hypothesis for Applying a Social Market Economy in Palestine” was published, analyzing the infrastructure of the Palestinian economy and its external and internal impediments, more specifically the political and economic reality, the distortions in the economy, lack of sovereignty, the PLO’s agreements with Israel. It further defines the current state of the Palestinian economy and outlines foundational requirements needed for the development of a Palestinian productive economy based on the social market economy principles.

Moreover, IoL was working on a policy brief entitled “Rule of Law Assistance to the Palestinian Authority: Challenges Ahead”. It addressed the obstacles to the rule of law in the Palestinian context and calls for “legitimate and planned ways” to provide assistance in the establishment of the rule of law according to the needs of the population. Recently, another policy brief on the social security law entitled “Palestinian Opposition to Social Security: Revolution or Devolution?” was published. It examines the neoliberal nature of the social security system the PA tried to put in place as well as the it’s mismanagement of public funds and the current fiscal crisis. The brief attempts to illustrate what a social security law approved by the Palestinian people would look like and what steps are required to achieve such law.
