Observers did not expect it to comply with the desired international standards, yet hoped it would be a step forward. The result of the 21 ASEAN Summit in Phnom Penh, Cambodia, is controversial. Its text and the process involved make it clear that the Southeast Asian community still has a long way to go to guarantee comprehensive rights to its 600 million inhabitants.

Although we realize that we have not - by any means - exhausted the stock of decisions worthy to be displayed, we hope that this Second Edition will find favour among those who resort to it.

As the guardian of the Constitution, the Federal Constitutional Court has shaped these rights through interpretation by a large body of case law. Taking note of the growing interest among scholars not only in continental Europe but more so in the Common Law world, an extensive English translation of that jurisprudence is very timely.
