KONRAD ADENAUER STIFTUNG - ICJ KENYA STAKEHOLDERS' CONFERENCE

Constitutional Change, Democratic Transition and the Role of the Judiciary in Government Reform: Questions and Lessons

Coming soon after the promulgation of the new constitution in Kenya, this conference sought to identify the role of the judiciary and jurists in ensuring that the implementation of the new constitution set good foundation for the realization of the rule of law and constitutionalism in Kenya.

KAS and ICJ Kenya convened a stakeholders' conference in Mombasa Kenya between 30th November and 3rd December 2010 on the theme 'Constitutional Change, Democratic Transition and the Role of the Judiciary in Government Reform: Questions and Lessons for Kenya'.

Coming soon after the promulgation of the new constitution in Kenya, this conference sought to identify the role of the judiciary and jurists in ensuring that the implementation of the new constitution set good foundation for the realization of the rule of law and constitutionalism in Kenya.

The conference sought to achieve this objective by

•examining the state and the role of judiciaries during the transition periods

•advancing scholarly debate on the rebuilding of institutions of governance

•exploring the kind of judicial institutions likely to emerge from post-conflict situations and their role in restoring the rule of law and democracy

•embedding integrity concepts in the judicial system and all key institutions in the field of the administration of justice

• exploring practical role of jurists in monitoring the implementation of the new Constitution in general, and the implementation of the Bill of Rights and the Judiciary in particular.

The conference brought together various stakeholders from government, parliament, the judiciary, lawyers, development partners and the civil society from Kenya, South Africa, Uganda, the United States and the Seychelles. Among the key speakers at the event were Hon. Kenneth Marende, the Speaker of the Kenyan National Assembly; Justice J.B. Ojwang' Resident High Court Judge of Mombasa; Hon. William Cheptumo, the Assistant Minister of Justice, National Cohesion and Constitutional Affairs of the Republic of Kenya; Lady Justice Yvonne Mokgoro, retired judge of the Constitutional Court of South Africa and the Chairperson of South Africa's Law Reform Commission; Prof. Kivutha Kibwana, a Special Advisor to the President of the Republic of Kenya on Constitutional and Legal matters; Justice Isaac Lenaola, the Chairman of Kenya Magistrates and Judges Association; Justice Fred Ochieng', the president of East African Magistrates and Judges Association among others.
