The conference marks the end of a one year long research project developed by the Bulgarian Lawyers for Human Rights Foundation in collaboration with the Rule of Law Program South East Europe of the Konrad-Adenauer-Stiftung. The aim of the project, the result of which will be presented at the conference, is to present the premises of a fair trial in administrative court proceedings established by the European Convention for the Protection of Human Rights and Fundamental Freedoms and the case law of the European Court for Human Rights, and to assess whether Bulgarian law and practice is in compliance with these standards. The conference will also offer an opportunity to learn about the characteristics of the German Administrative Procedural Law which will be presented by Dr. Günter Burmeister who as of June 1, 2008, will be a judge at the German Federal Administrative Court of Germany.
The focus of the project and conference lies on the following three topics:
- Problems of compatibility of the Bulgarian law with Article 6(1) of the European Convention on Human Rights due to legislative obstacles to the access to court in respect of some administrative acts.
- Scope of judicial control exercised by Bulgarian administrative courts in the light of the requirements of Article 6 and 13 of the European Convention on Human Rights.
- The Administrative Aspect of Applying the Liability of State and Municipalities for Damages Act (LSMDA): Problems of the Access to Court and the Scope of Judicial Control (Theses).
