Advancing Constitutional Expertise: Insights from the KAS-Jordanian Constitutional Court Collaboration Workshop

Delve into a day of constitutional enlightenment with the KAS-Jordanian Constitutional Court workshop. This one-day event, held at the Mövenpick Hotel in Amman, Jordan, brought together legal experts from diverse jurisdictions to explore the practical implementation of constitutional principles. From proportionality to living constitutionalism and the balance between individual rights and public order, this symposium offered a unique knowledge exchange that's shaping the legal landscape in the Middle East and North Africa.

On the 18th of October, 2023, the Konrad Adenauer Stiftung (KAS) organized an insightful and intellectually stimulating event in collaboration with the Jordanian Constitutional Court. The event, titled "Constitutional Implementation and Analysis in Practice," was held at the Mövenpick Hotel in Amman, Jordan. This gathering aimed to foster a comprehensive understanding of constitutional principles, their practical implementation, and their relevance in the evolving landscape of modern governance.

The event comprised three distinct panels, each delving into critical aspects of constitutional law, and featured distinguished legal experts from both national and international arenas. These panels served as platforms for the exchange of knowledge, ideas, and practical insights in the field of constitutional law.

 

Panel 1: The Principles of Proportionality and Practical Concordance: Balancing Constitutional Rights and Government Objectives

The first panel, titled "The Principles of Proportionality and Practical Concordance: Balancing Constitutional Rights and Government Objectives," brought together legal luminaries from Germany and Jordan. The panel featured BVR Prof. Dr. Henning Radtke, a Judge at the German Federal Constitutional Court, and Judge Taghreed Hikmet, a Judge at the Jordanian Constitutional Court. The panel was moderated by Judge Mohammad Talal Al-Hemsi, also from the Jordanian Constitutional Court. Following the expert presentations, an open discussion allowed attendees to engage in a constructive dialogue on this critical constitutional principle.

 

Panel 2: Living Constitutionalism: Adapting the Constitution to Modern Realities

The second panel, titled "Living Constitutionalism: Adapting the Constitution to Modern Realities," explored the dynamic nature of constitutional law and its adaptability to contemporary challenges. The panel featured Dr. Adel Omar Sharif, First Vice-President of the Egyptian Constitutional Court, and Judge Dr. Akram Masaedah from the Jordanian Constitutional Court. The discussion was moderated by Judge Hani Qaqeesh from the Jordanian Constitutional Court. As with the first panel, an open discussion encouraged participants to explore the implications of living constitutionalism in practice.

 

Panel 3: Monitoring the Constitutionality of Laws: interpreting the Constitution and balancing individuals' rights with public order

The third panel, "Monitoring the Constitutionality of Laws: Interpreting the Constitution and Balancing Individuals' Rights with Public Order," addressed the critical role of judicial review and the balance between individual rights and public order. The panel featured Judge Mireille Najm Checrallah, a Judge at the Lebanese Constitutional Council, and Prof. Dr. Maysa Bydoon, a Judge at the Jordanian Constitutional Court. The discussion was moderated by Judge Mohammad Essaid from the Jordanian Constitutional Court. Attendees actively participated in this discussion, exploring the nuances of interpreting constitutional provisions and upholding the rule of law.

 

Knowledge Exchange

This event provided a unique opportunity for attendees to engage with renowned legal experts from diverse jurisdictions. The exchange of knowledge, experiences, and perspectives contributed to a deeper understanding of constitutional law in practice. The panel discussions facilitated the sharing of best practices, challenges, and innovative solutions related to constitutional implementation.

KAS, in collaboration with the Jordanian Constitutional Court, remains committed to fostering dialogue and promoting the rule of law in the Middle East and North Africa. This event underscored the importance of such collaborations in enhancing legal systems and upholding the principles of justice, fairness, and constitutionalism.
