Law and practice of issuing administrative decisions - Foundation Office Vietnam
An administrative decision is a legal document issued by a government agency to make a specific decision on a particular issue within the scope of government administrative management. Issuing administrative decisions is a fundamental activity of the administrative system, which is the exercise of executive power in a state governed by the rule of law. Therefore, this process must also be in accordance with the law and ensure transparency and accountability of the issuing authorities. So far Vietnam lacks an administrative procedure law.
The seminar took place within the framework of the bilateral rule of law dialogue between Germany and Vietnam established in 2008. Speaking at the seminar, a renowned German expert in the field of administrative law Mr. Klaus Hage - presiding judge at the Administrative Court of Minden talked about the practice of issuing administrative acts in Germany by explaining the German Administrative Procedure Act (VwVfG) and the German Administrative Court Rules (VwGO).
Addressing at the seminar, Mr Florian Constantin Feyerabend, Resident Representative of Konrad-Adenauer-Stiftung Vietnam, shared that the political system and understanding of the rule of law in Germany and Vietnam may have many significant differences. Nevertheless, the discussion of the German Administrative Act could possibly provide some examples for the drafting of an administrative procedure law in Vietnam.
