Dispute Settlement Mechanisms – UNCLOS’ Indispensable Guardians

In anticipation of the 30th anniversary of the International Tribunal for the Law of the Sea in 2026, the Konrad-Adenauer-Stiftung Vietnam, the Diplomatic Academy of Vietnam (DAV), and the Australian Embassy, Vietnam proudly hosted the 14th Ocean Dialogue on “Dispute Settlement Mechanisms – UNCLOS’ Indispensable Guardians.” This timely forum in Hanoi highlighted the crucial role of dispute settlement mechanisms under the 1982 United Nations Convention on the Law of the Sea (UNCLOS), known as the "Constitution of the Oceans."

The Dialogue brought together global scholars, legal practitioners, and UNCLOS experts, whose insights enriched discussions on maritime dispute resolution's achievements, challenges, and future. It fostered a dynamic exchange of ideas, blending reflection with forward-thinking proposals. Ms. Olivia Schlouch from the Konrad Adenauer Stiftung Rule of Law Programme Asia also joined as one of the moderators.

The event featured four thought-provoking sessions, each exploring a critical aspect of UNCLOS dispute settlement mechanisms:

  • A Retrospective on Key Milestones: Panellists traced the evolution of UNCLOS mechanisms, celebrating landmark cases and decisions that have shaped global maritime governance.
  • Contributions to Peaceful Dispute Resolution: This session highlighted the tireless efforts of judges, arbitrators, conciliators, registrars, and staff in upholding the rule of law and ensuring amicable and equitable dispute resolution.
  • Development of the Law of the Sea: Experts discussed how UNCLOS mechanisms have advanced international maritime law, adapting to emerging challenges like environmental concerns and territorial disputes.
  • Forward-Looking Proposals: The final session sparked innovative ideas to enhance the efficacy of dispute settlement mechanisms, ensuring they remain robust in a rapidly changing global landscape.

By co-organizing this impactful Dialogue, Konrad-Adenauer-Stiftung Vietnam Konrad-Adenauer-Stiftung reaffirmed its commitment to fostering platforms for meaningful exchange on pressing global issues. The event’s actionable insights and collaborative spirit will undoubtedly strengthen UNCLOS mechanisms, ensuring they remain indispensable guardians of maritime governance.
