To go or not to go? - In contexts to the right to leave a country

POLICY BRIEF

The aim of this Policy Brief is to review the practices of the Macedonian border services in their treatment of certain categories of citizens, from the perspective of the legal protection provided by the competent authorities, and to help shape the answer to the question - "To go or not to go?", which from policy measure gained the dimension of struggle for individual human rights.

The right to leave any country, including your own, without unlawful restriction, is envisaged in Article 2 of Protocol 4 of the European Convention on Human Rights. The visible impact of the externalization of the EU border control policies (such as mandatory visa regimes and readmission agreements), aim to help the Union to cope with the burdened asylum systems and illegal entries into its territory. Consequently, the connection between the right to leave the country and the right to seek and enjoy asylum are evident. The second, as such, is not only protected by the Universal Declaration of Human Rights, but also with large number of other international instruments.
