Defending the EU’s Digital Sovereignty in the Trump Era

Over the past months, the EU and various member states have faced relentless attacks from U.S. tech billionaires. The EU has been accused by these corporations of censorship and unfairly targeting U.S. tech platforms with enforcement actions described as “tariffs”. Ceding the playing field to Big Tech in fear of retaliation from Trump will not lead to peaceful or productive relations between the EU and the U.S. The EU must double down on enforcement, ensuring ongoing investigations progress while considering bans on market access, corporate breakups, and trade restrictions.

Europe has developed a powerful regulatory toolbox to address digital challenges. For Europe’s SMEs and startups to scale up, it is not enough to invest in our infrastructure and innovation. We must clear space in the market. The effective enforcement of EU law against large, non-European companies is crucial. A taskforce of Chief Enforcement Officers with an overarching commission approach could deploy enforcement instruments strategically and coherently – without the need to further legislate.

Traditional businesses and civil society are increasingly dependent on large online platforms. How can we restore the balance to digital competition?

The study by Professors Marsden and Podszun draws on their deep professional experience and presents a pragmatic framework for use of the New Competition Tool, as well as asymmetric ex ante regulation by the European Commission. The design of this framework sticks to the principles of the social market economy because it reaffirms the values that should govern our vision for living in a digitized economy: free competition, fair intermediation, and sovereignty of users in decision making.
